<p><strong>Bazeta</strong> (bazeta.com) — Terms of Service. Version 1.0.</p> <p>These Terms of Service ("Terms") govern your access to and use of the website bazeta.com, its subdomains, mobile applications and related services (together, the "Service") operated by Bazeta ("we", "us", "our"). By creating an account, posting a listing or otherwise using the Service you agree to these Terms, our <a href="/legal/privacy" rel="noopener noreferrer">Privacy Policy</a>, <a href="/legal/cookies" rel="noopener noreferrer">Cookie Policy</a> and <a href="/legal/rules" rel="noopener noreferrer">Posting Rules</a>. If you do not agree, do not use the Service.</p> <h2 id="1-what-bazeta-is">1. What Bazeta is</h2> <p>1.1. Bazeta is an online classifieds marketplace. Users publish listings to sell, rent, buy, exchange or give away goods, offer or look for services and jobs, announce events, create dating profiles and present businesses. Businesses can open a company page ("Business cabinet"), take online bookings and buy booths at virtual exhibitions ("EXPO").</p> <p>1.2. <strong>We are a venue, not a party.</strong> Bazeta is not a party to any transaction, contract, booking or communication between users. We do not own, sell, resell, deliver, inspect or guarantee any item or service offered on the Service. Any agreement concluded through the Service is exclusively between the users involved.</p> <p>1.3. We do not verify the identity, capacity, legal status or truthfulness of users unless a "Verified" badge is displayed, and even then verification is limited to the checks described in the badge's description. Always use common sense: meet in public places, inspect goods before paying and never send money in advance to strangers. See our <a href="/help/safety" rel="noopener noreferrer">Safety tips</a>.</p> <h2 id="2-eligibility-and-accounts">2. Eligibility and accounts</h2> <p>2.1. You must be at least 18 years old (or the age of majority in your country, if higher) to create an account or post listings. The Dating section is strictly for adults aged 18 and over.</p> <p>2.2. You must provide accurate registration data and keep it up to date. One person may hold only one account; businesses may hold one account per legal entity plus manager seats added through the Business cabinet.</p> <p>2.3. You are responsible for everything that happens under your account. Keep your password secret and notify us at [email protected] immediately if you suspect unauthorised use.</p> <p>2.4. We may require email or phone verification, human verification (e.g. Cloudflare Turnstile) and, for certain categories or countries, proof of a licence or business registration before a listing is published.</p> <p>2.5. Accounts of persons or entities subject to international sanctions, or located in territories where we cannot lawfully provide the Service, may be restricted to read-only use.</p> <h2 id="3-listings-and-content">3. Listings and content</h2> <p>3.1. You may post only listings that comply with the law of the country where the listing is published and of the country where you are located, with these Terms and with the <a href="/legal/rules" rel="noopener noreferrer">Posting Rules</a>. The Posting Rules and our country policy matrix define which categories are unavailable, restricted or require a licence in each country.</p> <p>3.2. Each listing must describe one specific item, service, job, event or profile, be placed in the correct category and city, and contain truthful, complete and current information, including the true price and condition.</p> <p>3.3. You may not post duplicate listings, listings for prohibited items, misleading or deceptive listings, listings that infringe intellectual property rights, or content that is illegal, defamatory, obscene, hateful, harassing, or that reveals other people's personal data without permission.</p> <p>3.4. Listings expire automatically after the period set for their category (typically 30 days; 60 days for real estate; 90 days for dating profiles; 45 days for events). Expired listings can be renewed by their owner within 30 days; after that they are archived and their photos are deleted. Statistics may be retained in aggregate form.</p> <p>3.5. Moderation. Listings and messages may be checked automatically (rules, word lists and AI classification) and by our moderators before or after publication. We may decline, edit (for example to remove contact details placed in prohibited fields), hide, move to another category, or delete any content, and suspend or terminate accounts, where we reasonably believe that content or behaviour breaches these Terms, the law, or third-party rights, or harms the Service or its users. Where required by law we will notify you of the reason and of the possibility to appeal at [email protected].</p> <p>3.6. Reports. Any user may report a listing, profile, review or message. Content that receives several credible reports may be hidden automatically pending review.</p> <p>3.7. Feed and imported content. Some listings and business profiles are created from public data sources (for example job feeds or OpenStreetMap). They are marked accordingly, carry a link to the source, and may be claimed by their rightful owner. Data from OpenStreetMap is © OpenStreetMap contributors and available under the ODbL.</p> <h2 id="4-licence-to-your-content">4. Licence to your content</h2> <p>4.1. You keep all rights to the text, photos and other content you post. You grant Bazeta a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, adapt (including resizing, cropping, watermarking and translating), publish, distribute and display your content on the Service, in our mobile apps, in emails and notifications to users, in our social media channels and in search-engine and partner feeds, for the purpose of operating and promoting the Service. This licence ends when your content is deleted, except for copies in backups, caches or aggregated statistics, and except where content has been shared by other users or partners before deletion.</p> <p>4.2. Translations. We may translate your listing automatically into other languages. Translations are provided "as is"; the original text prevails in case of discrepancy.</p> <p>4.3. You warrant that you own or have all necessary rights to the content you post, and that it does not infringe the rights of any third party.</p> <h2 id="5-communication-chat-and-contact-details">5. Communication, chat and contact details</h2> <p>5.1. The Service provides an internal chat and a "show phone" function. Use them only to communicate about the listing in question. Bulk messaging, advertising, phishing, harassment and automated messaging are prohibited.</p> <p>5.2. We may store messages and reveal-phone events to protect users, detect fraud and comply with legal obligations. Messages may be scanned automatically for spam and prohibited content.</p> <p>5.3. For new accounts we may restrict the inclusion of links, phone numbers and email addresses in listing text for a limited period to prevent spam.</p> <h2 id="6-business-cabinets-bookings-and-reviews">6. Business cabinets, bookings and reviews</h2> <p>6.1. Business pages must represent a real business that you own or are authorised to represent. Claiming a business created from public data requires verification.</p> <p>6.2. Online bookings made through a business page create an appointment between the customer and the business. The business is responsible for honouring confirmed appointments and for the services provided; Bazeta is not a party to the appointment.</p> <p>6.3. Reviews and ratings may be left by users who have interacted with a listing, seller, business or booth. Reviews must be honest, based on genuine experience and free of abusive language. Businesses may reply publicly. We may remove reviews that breach these Terms, but we do not remove genuine negative reviews on request of the reviewed party.</p> <h2 id="7-paid-services">7. Paid services</h2> <p>7.1. We offer paid promotion of listings ("boosts"), Pro and Business subscriptions, EXPO booths and advertising placements. Prices, benefits and durations are shown on the <a href="/pricing" rel="noopener noreferrer">Pricing</a> page and at checkout. Prices are shown in USD or, where available, in your local currency; taxes may be added depending on your location.</p> <p>7.2. Payments on the website are processed by our merchant of record, Polar Software Inc. ("Polar"). In the mobile apps, purchases are processed by Apple App Store or Google Play under their terms. Subscriptions renew automatically until cancelled; you can cancel at any time from your billing page, the app store subscription settings or by contacting [email protected]. Cancellation takes effect at the end of the current billing period.</p> <p>7.3. A boost is applied immediately to the chosen listing and is not transferable. If we remove a boosted listing for breach of these Terms, the boost is forfeited without refund. If a listing is removed because of our error, we will re-apply the boost or refund it.</p> <p>7.4. EXPO booths and advertising placements are subject to the <a href="/legal/expo_terms" rel="noopener noreferrer">EXPO Exhibitor Terms</a> and the <a href="/legal/advertising_terms" rel="noopener noreferrer">Advertising Terms</a>.</p> <p>7.5. Refunds are handled according to our <a href="/legal/refunds" rel="noopener noreferrer">Refund Policy</a>.</p> <h2 id="8-advertising">8. Advertising</h2> <p>8.1. The free version of the Service displays third-party advertising (for example Adsterra on the web and Google AdMob in apps) and direct advertising placements. Pro and Business subscribers do not see third-party advertising. Advertisers are solely responsible for their advertisements.</p> <p>8.2. We do not endorse advertised products or services. Ads are labelled as such.</p> <h2 id="9-prohibited-conduct">9. Prohibited conduct</h2> <p>You agree not to:</p> <ul> <li>use the Service for any unlawful purpose or in breach of the Posting Rules;</li> <li>scrape, crawl, copy or harvest content or personal data from the Service, except for search-engine indexing of public pages in accordance with robots.txt;</li> <li>interfere with the Service, bypass security or bot-protection measures, or use automated tools to post or message;</li> <li>impersonate any person or entity, or misrepresent your affiliation;</li> <li>collect payments or deposits from other users for items you do not own or cannot deliver;</li> <li>upload malware or content designed to harm devices or data;</li> <li>resell access to the Service, or use it to build a competing database.</li> </ul> <h2 id="10-intellectual-property-of-bazeta">10. Intellectual property of Bazeta</h2> <p>The Service, its software, design, logos, trademarks, databases and editorial content (including articles) are owned by Bazeta or its licensors and are protected by copyright, database and trademark law. You may use the Service only as permitted by these Terms. Articles may be quoted with attribution and a link to the source.</p> <h2 id="11-third-party-services-and-links">11. Third-party services and links</h2> <p>The Service integrates third-party services (payment providers, maps, video embeds, app stores, push-notification providers) and may contain links to external websites. We are not responsible for their content, availability or privacy practices.</p> <h2 id="12-availability-and-changes">12. Availability and changes</h2> <p>12.1. We aim for high availability but do not guarantee uninterrupted or error-free operation. We may suspend the Service for maintenance and may change, add or remove features at any time.</p> <p>12.2. Automated assistants. Some functions (translation, category suggestion, article writing, the advertising assistant) use machine learning models. Their output may be inaccurate and is provided for convenience only.</p> <h2 id="13-termination">13. Termination</h2> <p>13.1. You may delete your account at any time from Settings. Active listings are removed; data is deleted or anonymised as described in the Privacy Policy.</p> <p>13.2. We may suspend or terminate your account, with or without notice, if you breach these Terms, if required by law, or if your account has been inactive for more than 24 months. Serious or repeated breaches (fraud, prohibited items, harassment) result in a permanent ban and may be reported to law-enforcement authorities.</p> <h2 id="14-disclaimers">14. Disclaimers</h2> <p>14.1. The Service is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy of listings, and non-infringement.</p> <p>14.2. We do not guarantee that any listing is genuine, lawful, available, or accurately described, that any user will complete a transaction, or that any business will honour a booking.</p> <h2 id="15-liability">15. Liability</h2> <p>15.1. To the extent permitted by law, Bazeta is not liable for any indirect, incidental, special, consequential or punitive damages, loss of profit, data or goodwill, arising from your use of the Service or from any transaction or communication with other users.</p> <p>15.2. Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim or (b) EUR 100.</p> <p>15.3. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or any liability that cannot be excluded under the law applicable to you. Statutory consumer rights are not affected.</p> <h2 id="16-indemnity">16. Indemnity</h2> <p>You will indemnify and hold harmless Bazeta, its officers, employees and partners from any claims, damages, losses and costs (including reasonable legal fees) arising from your content, your use of the Service, your transactions with other users, or your breach of these Terms or the law.</p> <h2 id="17-notices-complaints-and-dispute-resolution">17. Notices, complaints and dispute resolution</h2> <p>17.1. Notices to us: [email protected]. Notices to you: the email address on your account or in-app notifications.</p> <p>17.2. Complaints about content, including notices of alleged illegal content and intellectual-property infringement, can be submitted through the "Report" button on any page or by email to [email protected] with a description of the content, its URL, the reason and your contact details. We process notices diligently and inform you of the outcome.</p> <p>17.4. We encourage you to contact us first to resolve any dispute informally. If a dispute cannot be resolved within 60 days, it may be brought before the competent courts as set out in section 18. Nothing in this section prevents consumers from bringing claims in the courts of their own country of residence or before a consumer arbitration body where the law so provides.</p> <h2 id="18-governing-law">18. Governing law</h2> <p>These Terms are governed by the laws of the Republic of Cyprus, without prejudice to mandatory consumer-protection rules of the country where you habitually reside. The courts of Cyprus have jurisdiction, except that consumers may also sue and be sued in the courts of their country of residence.</p> <h2 id="19-changes-to-these-terms">19. Changes to these Terms</h2> <p>We may update these Terms to reflect changes in the Service or the law. Material changes will be announced on the Service or by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance. If you do not agree, stop using the Service and delete your account.</p> <h2 id="20-miscellaneous">20. Miscellaneous</h2> <p>20.1. If any provision of these Terms is held invalid, the remaining provisions remain in force. 20.2. Our failure to enforce a provision is not a waiver. 20.3. You may not assign your rights under these Terms; we may assign ours to a successor operator of the Service with notice to you. 20.4. These Terms, together with the documents they reference, constitute the entire agreement between you and Bazeta regarding the Service. 20.5.
